Instructions for cancellation

• Consumers have a legal right of cancellation when concluding a distant selling transac-tion, about which the provider informs in the following in accordance with legal regula-tions. Exceptions to the right of cancellation are regulated in Section II. Section III pro-vides a standard cancellation form.

  You have the right to cancel this contract within fourteen days without giving reasons.

  The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier have received the most recent goods.

  The cancellation period is fourteen days from the date of conclusion of the contract in the case of digital content that is not delivered on a physical data carrier.

  In order to exercise your right of cancellation, you have to notify us (Auerswald GmbH & Co. KG, Vor den Grashöfen 1, 38162 Cremlingen, Germany, Tel.: +49 (53 06) 92 00-225, Fax: +49 (53 06) 92 00-99, E-mail: shop@auerswald.de) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You may use the attached standard cancellation form, which however is not compulsory.

  In order to comply with the cancellation period, it shall suffice to send the notification of exercising the right of cancellation before the expiry of the cancellation period.

  Consequences of cancellation
  
  If you cancel this contract, we will refund to you all payments we have received from you, including delivery charges (other than any additional charges arising from you choosing a method of delivery other than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date we receive notice of your cancellation of this contract. We will use the same means of payment that you used in the original transaction for such refunds, unless expressly agreed otherwise with you; in no event will you be charged for such refunds.
  
  We may refuse any refund until we have received the goods back or until you have fur-nished proof that you have returned the goods, whichever occurs first.
  
  You are obliged to return or hand over the goods to us immediately and in any case at the latest within fourteen days of the day on which you notify us of the cancellation of this contract. The deadline is deemed to have been met if you dispatch the goods before the expiry of the fourteen-day deadline.
  
  You shall bear the direct costs for returning the goods.
  
  You only have to bear for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary to examine their nature, properties and functionality.
   
• Exceptions to the right of cancellation

  The right of cancellation does not apply to contracts for the delivery of sound or video re-cordings or computer software in a sealed package if the seal has been removed after delivery.
  
  The right of cancellation also expires in the case of a contract for the delivery of digital content not on a physical data carrier if we have commenced with the execution of the contract after you have expressly agreed that we shall commence with the execution of the contract before the expiry of the cancellation period and have confirmed your knowledge that you lose your right of cancellation through your consent upon com-mencement of the execution of the contract.
